Image, Likeness & Content Release

Effective Date: September 24, 2026
Last Reviewed: September 25, 2026
Version: 1.1

This Image, Likeness & Content Release applies when a voluntary OPYNARI participant, applicant, creator, representative, or other rights holder submits or authorizes names, images, recordings, or campaign materials for public use.

1. Grant of Permission

You authorize OPYNARI and Arpex Web LLC, together with their service providers acting on their behalf, to record where applicable and to use the approved participant’s:

  • name, professional name, username, and organization;
  • portrait, photograph, image, likeness, and appearance;
  • voice, statements, quotations, interviews, and recordings;
  • biography, professional information, social links, and campaign description;
  • logos, trademarks, artwork, video, audio, and other submitted materials; and
  • campaign participation, rankings, results, and related public information.

2. Authorized Purposes

The materials may be used to review applications; create, operate, display, and archive campaigns; identify participants; communicate results; produce reports; and promote OPYNARI, the campaign, and related Platform services.

Authorized uses may appear on OPYNARI websites, applications, social channels, presentations, newsletters, press materials, campaign pages, reports, dashboards, promotional material, and other digital or physical media connected to those purposes.

3. Scope of License

You grant a non-exclusive, worldwide, royalty-free, sublicensable license to reproduce, host, store, publish, display, distribute, transmit, translate, caption, crop, resize, format, and make reasonable editorial or technical adaptations to the authorized materials.

The license does not transfer ownership. It permits OPYNARI to exercise the granted rights through hosting providers, designers, translators, communications services, technical vendors, and distribution platforms solely for authorized purposes.

4. Editorial Adaptation

OPYNARI may make reasonable edits for length, clarity, grammar, translation, accessibility, file format, visual consistency, layout, or technical requirements. We will not knowingly use the materials in a materially false or unlawfully defamatory manner.

Final Platform layout, campaign presentation, placement, timing, and accompanying editorial context remain under OPYNARI’s control, subject to applicable law and campaign-specific commitments.

5. Your Representations

You represent that:

  • you are at least 18 years old and legally able to grant this Release;
  • you are the depicted person or have valid authority from the depicted person;
  • you own or control the necessary rights in the submitted materials;
  • you obtained required permission from photographers, videographers, designers, organizations, employers, and other rights holders;
  • the authorized use will not violate a contract, privacy right, publicity right, copyright, trademark, or other third-party right; and
  • the submitted information is not materially false or misleading.

6. Third-Party Materials

If a photograph, recording, logo, or other material was created or owned by another person, permission from the depicted person alone may not be sufficient. You are responsible for identifying third-party ownership and providing the necessary authorization or an approved alternative.

7. No Implied Partnership or Endorsement

This Release authorizes use of the materials but does not create employment, agency, sponsorship, legal partnership, or endorsement. OPYNARI may accurately state that a person voluntarily participated in the relevant campaign but may not use this Release to invent an unrelated endorsement.

8. Compensation

Unless a separate written agreement or campaign-specific term expressly provides otherwise, you understand that participation and the authorized uses are provided without compensation, royalties, residuals, reimbursement, or other payment.

9. Duration and Archival Use

This Release continues for the duration reasonably necessary to operate, promote, report on, and archive the campaign and Platform. Historical campaign pages, reports, presentations, security records, and materials already distributed may remain after active promotion ends.

10. Withdrawal

You may request that OPYNARI stop new uses of optional promotional materials by emailing privacy@opynari.com. A withdrawal is prospective and will be evaluated under applicable law. It may not require recall of materials already lawfully published or distributed, alteration of historical results, deletion of aggregate statistics, removal from protected backups, or removal of copies controlled by independent third parties.

If consent is the legal basis for a particular use, withdrawal will not affect the lawfulness of processing completed before withdrawal.

11. Release of Claims

To the extent permitted by law, you release Arpex Web LLC and persons acting within the scope of this authorization from claims arising solely from authorized use of the materials, including claims concerning inspection or approval of final formatting, provided the use is not outside the scope of this Release.

This Release does not waive rights or liability that cannot lawfully be waived and does not release fraud, willful misconduct, or unauthorized use.

12. Privacy

Personal information connected to the submission is processed according to the OPYNARI Privacy Policy and campaign-specific notices. Public campaign materials should not contain unnecessary sensitive personal information.

13. Electronic Acceptance

You agree that checking an acceptance box, applying an electronic signature, or submitting materials through a process that clearly presents this Release may constitute electronic acceptance to the extent permitted by law. OPYNARI may retain a record of acceptance, including date, time, account, campaign, and version.

14. Contact and Rights Questions

For correction, withdrawal, ownership, or authorization questions, email privacy@opynari.com and identify the applicable campaign and material.
