This Copyright, Trademark & Other Rights Complaints Policy explains how to report material on OPYNARI that you believe infringes copyright, trademark, privacy, publicity, or another legal right.
1. Good-Faith Notices
Submit a notice only if you have a good-faith basis and are the rights holder or authorized to act for the rights holder. A knowingly false or materially misleading notice may create legal liability. OPYNARI may request additional information reasonably necessary to evaluate identity, authority, ownership, context, defenses, or the location of the material.
2. Copyright Complaints
A copyright notice should include:
- your physical or electronic signature;
- identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are covered;
- identification and precise location of the material claimed to be infringing, including the relevant OPYNARI URL or campaign;
- your name and contact information;
- a statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or law; and
- a statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorized to act for the owner.
Notices intended to invoke the U.S. Digital Millennium Copyright Act must also satisfy applicable statutory requirements and be delivered through the rights-complaint contact or designated-agent information currently published by OPYNARI.
3. Copyright Counter-Notice
If material you submitted is removed or restricted because of a copyright notice and you believe that action resulted from mistake or misidentification, you may submit a counter-notice containing:
- your physical or electronic signature;
- identification of the removed or restricted material and its previous location;
- a statement under penalty of perjury that you have a good-faith belief the material was removed or restricted because of mistake or misidentification;
- your name, address, and telephone number;
- the legally required consent to jurisdiction and acceptance of service of process; and
- any additional information required by applicable law.
Where the statutory process applies, OPYNARI may forward a valid counter-notice to the original claimant and may restore material after the legally applicable period unless the claimant reports a qualifying court action.
4. Trademark Complaints
A trademark complaint should identify the mark, jurisdiction, registration number where applicable, owner, allegedly infringing material, exact URL, nature of the claimed confusion or misuse, and requested action. Include evidence of authority and explain why the use is not nominative, descriptive, editorial, comparative, critical, or otherwise lawful.
Reference to a name, logo, or trademark in an editorial campaign does not by itself establish sponsorship, affiliation, or infringement.
5. Name, Image, Likeness, and Publicity Complaints
If you believe OPYNARI material unlawfully uses a person’s name, image, likeness, voice, identity, or persona, identify the person, your authority, the specific material, the jurisdiction and right asserted, the relevant context, and the requested action.
OPYNARI will consider consent, editorial and public-interest context, newsworthiness, identification, commentary, comparison, advertising use, campaign status, and applicable law. A request does not guarantee removal where continued use is lawful.
6. Privacy and Personal Information Complaints
For private, sensitive, inaccurate, or unlawfully disclosed personal information, identify the material and explain the privacy interest or legal basis. Do not repeat unnecessary sensitive information in the notice. Requests to exercise access, correction, deletion, or other data rights should use the Data Rights Request Process.
7. Impersonation and False Affiliation
Report accounts, pages, or materials that impersonate a person or organization or falsely claim sponsorship, endorsement, partnership, or official status. Provide reliable evidence of identity or authority and the specific representation at issue.
8. OPYNARI Review
OPYNARI may remove, restrict, replace, preserve, or decline to act on material after considering the notice, available evidence, responses, lawful defenses, Platform terms, public interest, and applicable law. We may notify the person who submitted the material and provide relevant portions of the complaint so that the person can respond.
We may act immediately where material presents a credible safety, privacy, security, or legal risk. We may also preserve records needed for legal compliance, disputes, fraud prevention, or defense of claims.
9. Repeat Infringement
Where appropriate and legally required, OPYNARI may suspend or terminate accounts of repeat infringers. We consider the nature, validity, frequency, context, and resolution of complaints and do not treat an unsupported allegation as a final determination.
10. Abuse of the Process
Do not use this process to suppress lawful criticism, competition, commentary, reporting, parody, fair use, or public discussion. OPYNARI may reject incomplete, fraudulent, abusive, or duplicative notices and may restrict access to the complaint process when it is used to harass or deceive.
11. No Legal Determination
OPYNARI’s content decision is an operational response and is not a court judgment concerning ownership, infringement, liability, or the ultimate rights of the parties. Parties may seek independent legal advice or pursue remedies available under law.
12. How to Submit
Use the official rights-complaint form or contact method published on OPYNARI or in the OPYNARI Legal Documents area. Clearly identify the type of complaint and retain confirmation of submission. Statutory notices remain subject to all legally required delivery and content requirements.
